Terms of Service

1Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you or the entity you represent ("Client", "you", or "your") and Digital Maniac ("Digital Maniac", "we", "our", or "us"). By signing up, accessing, or using the Digital Maniac platform, APIs, or software services, you agree to be bound by these Terms.
2Meta WhatsApp Business Solution Terms Compliance
Digital Maniac provides software interfaces and middleware to connect your business to the official Meta WhatsApp Business Cloud API. You acknowledge and agree that your usage must strictly comply with:
Zero Tolerance for Spam: You must maintain verifiable proof of opt-in for all recipient phone numbers. Unsolicited spam, deceptive promotional messages, harassment, or distribution of prohibited goods (e.g., narcotics, weapons, unauthorized adult content) will result in immediate termination of service and suspension of your WABA account by Meta.
3Account Registration & Security
You must provide accurate, current, and complete information during workspace registration. You are responsible for safeguarding your login credentials, API keys, and webhook secrets. You must immediately notify Digital Maniac if you suspect any unauthorized access to your workspace.
4Pricing, Telecom Billing & Subscriptions
- Platform Subscription: Digital Maniac charges a recurring flat fee according to your chosen plan tier (Starter, Growth, Scale, or Enterprise), billed either monthly or annually.
- Meta Direct Telecom Usage: Conversation charges imposed by Meta are paid directly by you to Meta via your Meta Business Manager payment method at official telecom rates with ₹0.00 markup by Digital Maniac.
- Taxes: All subscription prices are exclusive of applicable Indian Goods and Services Tax (GST) or international sales tax.
5Service Level Agreement (SLA)
Digital Maniac targets a 99.9% uptime for our core dashboard, webhook listeners, and broadcast API services. This SLA excludes scheduled maintenance windows and upstream interruptions on Meta’s global WhatsApp network.
6Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
